NGO Montenegro International filed a criminal complaint with the Special and Supreme State Prosecutor’s Offices in accordance with Art. 188 of the Criminal Code of Montenegro, Art. 24 of the Law on Montenegrin Citizenship and Art. 11 of the Law on Election of Councilors and Deputies as well as other legal regulations of the state of Montenegro against:
- Members in the Ministry of Internal Affairs responsible for the registration of citizens’ voting rights and registration and deletion of Montenegrin citizenship;
- Citizens who are registered in the voter list of another state and will vote in the upcoming elections in Niksic;
- Members of the Parliament of Montenegro who are registered in the electoral roll of another state.

We remind you that Art. 11 of the Law on Election of Councilors and Deputies defines that the right to vote and to be elected as a deputy / councilor has a voter who is 18 years old, who has resided in Montenegro at least two years before election day and who has a residence in the municipality, the city municipality, as a constituency, it is stated in the application.
Regarding the compilation of inaccurate voter lists, Article 188 of the Criminal Code of Montenegro defines: “Whoever, in order to influence the election results or in a referendum, compiles an inaccurate voter list, shall be punished by a fine or imprisonment for up to three years”, while Article 24 of the Law on Montenegrin Citizenship that an adult Montenegrin citizen, who also has the citizenship of another state, loses Montenegrin citizenship by force of law and that the competent authority is officially obliged to initiate proceedings, after learning about the facts referred to in paragraphs 1 to 3 of this Article.
WE REQUEST YOU TO ASK AND CHECK THE LIST OF ALL CITIZENS WHO ENTERED THE TERRITORY OF MONTENEGRO IN THE PAST 45 DAYS FROM THE COMPETENT STATE AUTHORITIES AND TO CHECK WHETHER THE SPECIAL PERSONS ARE FIND IN VOTER LIST. IN THE EVENT THAT THE SAME PERSONS ARE ON THE VOTER LIST OF MONTENEGRO, WE DEMAND A VERIFICATION OF THEIR VOTING RIGHTS IN THE TERRITORY OF THE STATE IN WHICH THEY HAVE RESIDENCE. IF IT IS DETERMINED FOR THE SAME PERSONS THAT THEY HAVE EXERCISED THE RIGHT TO VOTE IN THE ELECTIONS IN NIKSIC AND THEY HAVE THE SAME RIGHT ON THE TERRITORY OF ANOTHER STATE, WE DEMAND THEIR CRIMINAL PROSECUTION IN ACCORDANCE WITH LAW.
WE ALSO REQUIRE CRIMINAL PROSECUTION AGAINST ALL PERSONS WHO DID NOT ACT IN THE OFFICIAL DUTY, AS WELL AS PERSONS WHO WERE ON THE ELECTORAL LIST AND WERE ELECTED AS MEMBERS AND MEMBERS OF THE UNITED NATIONS CONSIDERING THAT, IN ACCORDANCE WITH THE LAW ON MONTENEGRIN CITIZENSHIP, THE SAME PERSONS LOSE MONTENEGRIN CITIZENSHIP UNDER AUTOMATION (“FORCE OF LAW”).
WE DEMAND THE PROSECUTOR’S OFFICE AND THE COMPETENT STATE AUTHORITIES TO CRIMINATE, DELETE FROM THE VOTER LIST AND DEPRIVE THE MONTENEGRIN CITIZENSHIP OF ALL PERSONS WHO ACT CONTRARY TO THE LAW.
